Processos de mobilização do direito no desastre de mineração da Samarco no rio Doce: a luta pelo reconhecimento dos camaroeiros da Praia do Suá, Vitória/ES

Resumo

The Doce river disaster, resulting from the rupture of the Fundão dam, Minas Gerais, is the biggest environmental disaster in the history of Brazil and one of the biggest miningrelated disasters in the world. Its impacts were not limited to the State of Minas Gerais, also impacting the State of Espírito Santo in the same proportion, especially on its coast. The tailings, after reaching the Doce river mouth, spread along the coast, reaching the north and south of the State. One of the first judicial measures was the prohibition of fishing at the Doce river mouth, which is still in force and affects thousands of fishermen and fisherwomen. One of these affected groups is located in the municipality of Vitória. It’s the shrimp fishermen community from Praia do Suá, Vitória/ES. Formed by owners, masters, crew and members of their support chain, this affected group had (and still has) a peculiar challenge in the Doce river reparation process. Once they are located at an limit not recognized by judicial decisions or by the disaster governance, they had to organize and mobilize to seek their recognition. This affected recognition process of oneself develops from the legal consciousness formation and from the activation of justice institutions and with the support of Movement of People Affected by Dams (MAB). This research aims to study how the process of legal mobilization by the shrimp fishermen took place, its main characteristics and how the group's interactional and cognitive mechanisms were developed with the other actors in the reparation process, especially with the Public Defenders Office of Espírito Santo, and which contributed to the construction of the framework of injustice and the choice of arenas, repertoires and performances of the political confrontation with the Renova Foundation and companies, and how they understand the legacy left by the legal mobilization.
