Resumo

This dissertation’s purpose is to understand the conservative constraints belonging to the Brazilian state-owned in the wake of legal propositions regarding special educations. The theoretical documental study establishes as object the educational political regulations constraints of schooling processes of the disabled, development global disorders, giftedness students, in the scope of the Educational Municipal Plans propositions in the districts of Vila Velha, Vitória and Serra - ES. The work presents as theoretical-methodological referential the historic-dialectic materialist perspective, taking over the concepts of State and Civil Society, to discuss, within the framework of the neo-liberal reform education-oriented, from the decade of 90, the influence of international orientations concerning the definition of educational policies by the Brazilian government (state), its organization in the national context and the local implementation. In the historic clash between the right to education and the government’s duty to educate their population, the study theorizes the Brazilian State’s role in the nature of the actions shared alongside the civil society, identifying the liberal State’s implication in the design of determinant educational public policies of basic schooling processes of those students, who are the target audience of special education, with disabilities, development global disorders, giftedness, constituting an analytical theoretical body that elucidates the limits of the inclusive educational propositions before the logic that does not require the action of the capitalist State. It characterizes, the political and economic determinants established by international funding agencies and their orientation of joint responsibility of the civil society. Such elements, absorbed by state action, enforces the target audience students with disabilities, global disorders of development, giftedness the offer of a Special Educational Service inside institutional spaces other than the school, preserving partial and restrictive ways to the schooling processes of those who attend the space of specialized institutions in order to complement or add to regular curriculums. The partiality and restriction of these formats change the education inclusion movement achievements into partial achievements, once the liberal State corrupts principals of the Special Education Service universalization, stablishing it as an open support service to private, relief or philanthropic initiative, with segregator intent, in the form of provision of services, in a perspective that equates and adjusts social policies according to the national and foreign capital interest.
