Apontamentos sobre a verdade como fenômeno endoprocessual

Abstract

This paper aims to analyze the procedural truth. Therefore, it is an investigation of different ways to obtain the truth in the process, throughout history. It also studies the truth from the standpoint of philosophy, that has had many ways to get to the truth. In philosophical point of view, we present some points relating to language and semiotics. The work also includes the analysis of issues has long been consolidated in procedural doctrine, as the false dichotomy between real truth and formal truth, as well as the improbability to achieve the reproduction of facts, but rather an approximation of the truth (possible truth). Is debating even to influence the judge's subjectivity in the decision. Finally, we investigate the truth as a legitimating factor of res judicata.
