This research, entitled "Home school attendance in the municipal education system of Vitória - ES: a case study", had the general objective of investigating how home school attendance (AED) has been organized and occurred in the municipal education system. of Vitória - ES. In order to reach the general objective, we sought studies that had home school care as an analytical focus and that would help us to think about both this study and the execution of the research. We also bring the definition of concepts that we consider important for the approach and understanding of the theme, such as: “Special Education and Inclusive Education”. We deal with the right to education, seeking to identify in the context of Brazilian legislation the legal provisions that ensure and organize home school care; in addition to focusing on the learning process and development based on Vygotsky's assumptions, as he understands that this theoretical basis brings essential elements to the understanding of the theme. The study was developed from a qualitative perspective. As a research methodology, we chose to develop a case study. We understand that this can provide both a theoretical-practical contribution of consistency to the further study of aspects related to the central theme of our research, as well as raising other studies as unfoldings of the central focus. Semi-structured interviews and document analysis were the procedures adopted to carry out the data production. Considering education as a right for all, as provided for in the Federal Constitution (BRASIL, 1988), and in a series of other Brazilian legislations, in addition to the theoretical studies already carried out, we defend the thesis that the offer of Home School Care by the systems of Teaching is extremely important so that students, with or without disabilities, unable to attend school, temporarily or permanently, can have their rights to learn and develop guaranteed, at home.
