A história da saúde como direito fundamental no Brasil: a atuação do Tribunal de Justiça do Espírito Santo e a efetivação da cidadania nos primeiros 25 anos da Constituição Federal de 1988

Abstract

The proposal of this presentation is to know, analyze, discuss and to show up the historical health care per Brazil's fundamental right. Studies based on Court of Justice's ambience of the State of Espírito Santo and its role as guarantor of constitutional rights at the regional ambit. The research focuses on the first 25th of the Brazilian Constitution of 1988, however, in keeping with the historical health path until it is enshrined as a fundamental right in Brazil, which will enable us to know the reasons and events that led the elevation of this right, as well as verify that effectiveness through acting of the Espírito Santo's Judiciary. It seeks to present the reception and understanding of this constitutional guarantee by the regional magistracy, as well as chief judges's acting in this processes related to the matter and reflections on Espírito Santo's society, accomplishing the necessary historiographic record.
